Super Duper — Terms & Conditions

1. Agreement to these Terms

These Terms & Conditions ("Terms") are a legal agreement between you ("you," "your," or "Customer") and Ryan Andersen Consulting, LLC, a California limited liability company ("Super Duper," "we," "us"). By creating an account, connecting your Ontraport account, or using the Service, you agree to these Terms and to our Privacy Policy. If you're agreeing on behalf of a company, you represent that you're authorized to bind it.

2. What Super Duper is

Super Duper is a reporting tool over your Ontraport data. We offer:

• Weekly Snapshot (Free): a recurring summary of your account's key metrics, delivered by email and viewable in your account, with AI-written summaries.
• Bespoke: custom reporting and integration work, scoped and priced separately.
• Paid add-ons and services: some features and services are paid — for example, custom metrics tailored to your business, and optional extras such as trainings or Loom walkthroughs — offered separately from the free functionality.

We may add, change, or discontinue features. The Service is provided on an ongoing, evolving basis. Custom work and integrations built for a specific customer are covered by a separate agreement with that customer, not by these Terms.

3. Accounts, eligibility, and credentials

• You must be at least 18 and using the Service for business purposes.
• You're responsible for keeping your login credentials secure and for all activity under your account.
• Your Ontraport API credentials. You are responsible for providing valid credentials and for the level of access they grant. You may revoke them at any time in Ontraport, which ends our access. We store them encrypted and use them only to provide the Service.
• Access is authenticated by default. Your data is available through your logged-in account. The one exception is optional sharing: you may enable a public link for a specific dashboard, after which anyone with the link can view it without logging in. This is off by default, entirely at your discretion, and you are responsible for what you choose to share publicly — including any personal data of your contacts that a shared view may contain.
• Communications. By signing up, you agree to receive the Weekly Snapshot and account/service messages (which are part of the Service), as well as occasional promotional emails about Super Duper and Ryan Andersen Consulting's related services and offers. You may unsubscribe from promotional emails at any time via the link in those emails; account and service messages are necessary to provide the Service and cannot be opted out of while your account is active.

4. Your data and your contacts — your responsibilities

• The Ontraport data you connect — including your contacts' personal information — is yours (or your contacts'), not ours. We act as your service provider / processor and handle it under your instructions and our Privacy Policy.
• You are responsible for having the legal right and a lawful basis to collect, store, and process your contacts' data, and for your own privacy obligations to those contacts (notices, consents, and honoring their rights). Super Duper is a tool you point at data you already control.
• You will not use the Service with data you're not permitted to process.

5. Acceptable use

You agree not to: use the Service unlawfully or to violate anyone's privacy or rights; attempt to breach or probe our security or access another customer's data; reverse engineer, scrape, or resell the Service except as expressly allowed; overload or interfere with the Service; or use it to process data you have no right to. We may suspend or terminate accounts that violate these Terms.

6. Plans and billing

• Super Duper's out-of-the-box functionality is currently provided free of charge, and no payments are processed through the Service today. We reserve the right to change this at any time — including to require payment to continue using functionality that is free today — on reasonable advance notice. We hope to keep the core functionality free, but you should not rely on any currently-free feature remaining free indefinitely.
• Some features and services are paid, including custom metrics tailored to your business and optional extras such as trainings and Loom walkthroughs; these are separate from the free out-of-the-box functionality.
• If we introduce paid plans, additional billing terms will apply and will be presented to you before you are charged.

7. The nature of the Service — read-only, and "as is" insights

• Read-only. Super Duper reads your Ontraport data to report on it. It does not, and by design cannot, modify or delete data in your Ontraport account.
• Insights are informational, not advice. Super Duper's reports, metrics, trends, and AI-generated analysis (including any financial figures such as MRR or ARR calculations) are provided for informational purposes to help you see your data. They may contain errors, gaps, or misinterpretations, and depend on the quality of the underlying data. They are not financial, legal, tax, or business advice, and you should independently verify any number before acting on it. You're responsible for decisions you make based on the Service.

8. Intellectual property

• We own the Service — the software, dashboards, designs, and everything except your data. We grant you a limited, non-exclusive, non-transferable right to use it while your account is active.
• You own your data. You grant us the rights needed to access and process it to provide and quality-check the Service, and to use aggregated, de-identified data to improve the Service and for the research, benchmarking, and storytelling described in the Privacy Policy.
• Feedback you give us may be used without obligation to you.

9. Third-party services and no Ontraport affiliation

• The Service depends on third parties (Ontraport, and the providers listed in the Privacy Policy). We're not responsible for their availability, changes, or acts, and their terms govern your use of them.
• Super Duper is an independent product and is not affiliated with, endorsed by, or sponsored by Ontraport. "Ontraport" is a trademark of its owner; we reference it only to describe compatibility.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that reports will be complete or accurate.

11. Limitation of liability

To the maximum extent permitted by law, Ryan Andersen Consulting, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$100.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your data, your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including claims by your own contacts relating to data you processed through the Service.

13. Termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or to comply with law. On termination, your right to use the Service ends; data handling on termination is described in the Privacy Policy (Section 8). Deleted data is removed from our live systems promptly and from our backups within 30 days, except for residual copies our infrastructure providers may briefly retain under their own practices.

14. Changes to these Terms

We may update these Terms. Material changes will be posted with a new "Last updated" date and, where appropriate, notified to you. Continued use after changes means you accept them.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, and the state and federal courts located in San Francisco County, California will have jurisdiction.
